Agreement between User and Casacura
Welcome to Casacura's online courses (the "Courses"). The Courses are provided by Casacura, a company registered in British Columbia, Canada, and are hosted on the platform operated by Thinkific Labs Inc. ("Thinkific"). By accessing or using the Courses, you agree to be bound by these Terms of Use and Release. If you do not agree to these terms, please do not use the Courses.
1. Use of Courses
Casacura provides educational materials, content, assessments, and related information through the Courses (the "Materials"). As a user ("User"), your enrollment in the Courses is valid until the end of the calendar year. This is referred to as the “Enrollment Period”. During this period, you are granted a non-exclusive, non-transferable license to access and use the Materials for personal educational purposes. You may download and print one copy of the textual and non-video materials for your personal use, provided you retain all copyright and proprietary notices.
However, please note that video recordings are not available for download and are intended for online streaming only. You may access video content exclusively through the provided online platform during the enrollment period.
2. Coaching Sessions
If you choose to purchase coaching sessions or take advantage of discounted coaching session offers, please note that such sessions are limited to a maximum of five 30-minute sessions. These sessions must be utilized within the enrollment period. Any unused coaching sessions will expire after the enrollment period ends.
3. User Responsibilities
By accessing and using the Courses, you warrant that you are not affiliated with any competitor of Casacura and that you will use the Materials solely for the purpose of your personal educational enrichment. You also agree to use our courses for lawful purposes and not to engage in any activity that may disrupt or harm the platform, instructors, or fellow learners.
4. Intellectual Property
The "Casacura" name and associated trademarks are the property of Casacura. The Materials provided through the Courses are protected by copyright and other intellectual property laws. Unauthorized use, distribution, or reproduction of the Materials is prohibited and may violate applicable laws.
5. External Links
The Courses may contain links to external websites for informational purposes. Casacura does not endorse or control these external websites and is not responsible for their content. Accessing external websites through provided links is at your own risk.
6. Disclaimer of Warranties
The Courses and Materials are provided "as is" without any warranties, expressed or implied. Casacura does not warrant the accuracy, completeness, or suitability of the Materials. Casacura reserves the right to update, modify, or discontinue the Courses or Materials at any time without notice.
7. Limitation of Liability
Casacura, its affiliates, and Thinkific shall not be liable for any damages arising from the use or inability to use the Courses or Materials, including but not limited to indirect, incidental, consequential, or punitive damages. You assume all risks associated with the use of the Courses.
8. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of the province of British Columbia, Canada, without regard to its conflicts of law principles. Any disputes arising from or related to the Courses shall be subject to the exclusive jurisdiction of the courts of British Columbia.
9. Release and Authorization
By accessing and using the Courses, I understand and acknowledge that my participation in the online courses may involve recorded sessions, including Question, Dialogue, or Demonstration sessions ("Dialogue"). I hereby grant Casacura and its authorized representatives the rights as outlined in the provided Release. I acknowledge that my participation in the recording of Dialogues is voluntary and that there may be risks associated with disclosing personal information. I release and hold harmless Casacura, its officers, agents, licensees, and assigns from any claims, damages, or liability arising from or related to my Performance or the Content.
10. Changes to Terms
These Terms of Use may be updated by Casacura without prior notice. It is your responsibility to review these terms periodically. Your continued use of the Courses after any changes constitutes acceptance of the revised Terms of Use.
Release

I understand and acknowledge that my participation in the online courses provided by Casacura (the "Courses") includes the possibility of recorded sessions, including but not limited to Question, Dialogue, or Demonstration sessions ("Dialogue"). I hereby grant Casacura and its authorized representatives, without limitation, all rights of every kind and character whatsoever in and to:
1. My performance, appearance, name, likeness, image, and voice in connection with the Dialogue (collectively, my "Performance").
2. The results and proceeds of my Performance, including any content created during or as a result of my participation (the "Content").
I grant Casacura the rights to reproduce, prepare derivative works, distribute copies of, publicly perform, and publicly display my Performance, the Content, and the results and proceeds thereof for educational and commercial purposes. This grant includes the right to use my Performance and the Content for promoting the Courses and educating Casacura's students, health professionals, and the general public.
I authorize Casacura to create photographs, audio recordings, video recordings, and other recordings of my Performance (collectively, the "Content") on any media now or hereafter created, and to edit, duplicate, and use my Performance and the Content as Casacura deems fit. I also authorize Casacura to license others to use the Content for various purposes, including advertising, marketing, sales promotion, publicity, commercial tie-ups, and educational materials.
I understand that Casacura owns and retains all copyright interests to the Content. I irrevocably waive any rights and interest in the results and proceeds of my Performance and the Content. I waive any right to inspect, modify, or approve the Content, and any right to restrain or interfere with the use, distribution, exhibition, or exploitation of my Performance or the results and proceeds thereof. I release any claims I may have against Casacura for libel, slander, invasion of privacy, copyright or trademark violation, right of publicity, or false light arising from or in connection with this Release.
I acknowledge that I will not receive any additional consideration in connection with this Release, my Performance, the Content, or any other results or proceeds of my Performance. I release, defend, and hold harmless Casacura, its officers, agents, licensees, and assigns from any claims, damages, or liability arising from or related to my Performance or the Content.
I understand that my participation in the Dialogue is voluntary and that disclosing personal information during the Dialogue, even in carefully monitored online formats, carries certain risks. I acknowledge that I have been informed of the possible risks and that Casacura cannot guarantee the complete security of my personal information.
By agreeing to this Release, I acknowledge that:
- I have been offered the opportunity to speak with a representative of Casacura and to consult with legal counsel regarding this Release.
- I am at least the age of majority in my state or province of residence and have the right to enter into this Release willingly and freely.
- This Release is bound and enforceable under the laws of the jurisdiction of British Columbia, Canada.
- I have read and fully understand the content, meaning, and impact of this Release and agree to all that is stated above.
- My consent reaffirms my agreement to be bound by the terms and conditions of this Release.
Consent
By accessing and using the Courses, you acknowledge that you have read, understood, and agreed to both these Terms of Use and the Release.
